Collaborative Practice
No one marries with the intention of divorcing. The emotional and financial costs of divorce can be adverse and long-lasting on the entire family.
Many couples are able to resolve their disputes through collaborative divorce. This is a non-adversarial approach to divorce and separation which avoids the financial and emotional burdens of litigation. Each party is represented by their own attorneys and are aided by additional collaborative professionals who are committed to helping their clients reach settlement without resulting in a trial.
Qualified Domestic Relations Orders (QDROs)
What is a QDRO?
A QDRO is a court order that assigns a portion of your or your former spouse’s retirement/pension plan. A QDRO must be submitted to and approved by the retirement/pension plan administrator in order for the benefits to be assigned to the former spouse who is not the plan participant. The order details how the retirement assets should be divided between you and your former spouse and must meet specific requirements to be treated as a QDRO.
With her extensive experience advising retirement/pension plan administrators and reviewing QDROs, Michelle Kauppila is able to draft and/or review QDROs to help you through this process as efficiently as possible.
